Shire Files Patent Lawsuit Against Cadila

From Associated Press (July 8, 2010)

NEW YORK -- Irish drug maker Shire PLC said Thursday it has filed a patent infringement suit against Indian generic drug developer Cadila Healthcare Ltd. over the bowel disorder drug Lialda.

Shire said Cadila is doing business as Zydus Cadila and Zydus Pharmaceuticals Inc., and that Zydus has asked the Food and Drug Administration to approve a generic version of Shire’s Lialda before the expiration of its patent.

Lialda, called Mezavant outside the U.S., had sales of $235.9 million in 2009.

The suit was filed in U.S. District Court in Delaware.

A caller seeking comment from Cadila after hours in India was told to call back during business hours.

Shire’s U.S. shares rose 43 cents to $64.46 in morning trading Thursday.
