Former Serono Employee Not Guilty in Health Care Fraud Case

BOSTON--(BUSINESS WIRE)--May 3, 2007 - Mintz Levin today announced that they had achieved a verdict of not guilty on all counts for their client, a former employee of Serono, Inc. The jury trial in U.S. District Court in Boston lasted 2 1/2 weeks and cleared the clients of charges of conspiracy and violating the Medicare Anti-Kickback statute.

Serono had previously pleaded guilty and paid civil and criminal penalties totaling $700 million on related charges.

The lead attorney in the case, Tracy Miner, and her team also achieved a victory two years ago in a similar case involving TAP Pharmaceuticals. Mintz Levin received a directed verdict on behalf of their client, an employee of TAP while TAP pleaded guilty and paid $880 million in penalties.
