Clopidogrel Cleared for Marketing in Germany – Higher Administrative Court in Münster Backs the Immediate Execution of Approval
BASEL, Switzerland, Aug. 4, 2008. 07.00 hrs. --- Cimex AG received approval from the BfArM (Federal Institute for Drugs and Medical Devices, Germany) for clopidogrel (original product: Plavix® / Iscover® by Sanofi-Aventis / Bristol-Myers Squibb) in Germany and transferred it to its marketing partners. Beyond that the German Administrative Court in Cologne (Verwaltungsgericht Köln) ordered the immediate execution of the approval in its decision communicated on July 29, 2008, to remove the suspensory effect of a third-party challenge against the approval from Sanofi-Aventis.
Subsequently, Sanofi-Aventis appealed to the German Higher Administrative Court in Münster (Oberverwaltungsgericht Münster) against the ruling of the Administrative Court in Cologne requesting a temporary suspension of the immediate execution of the approval. However, the Higher Administrative Court in Münster dismissed this appeal on August 1, 2008.
Hence, this ruling cleared the way for the partners of Cimex to start marketing clopidogrel in Germany.
