Default Drug Change, Olanzapine?

Can a DR. that has no clue to history of patient, hand over olanzapine without a prescription?
Not only without a prescription, but to someone who has depression, with no antipsychotic behaviours?
Need this information ASAP. I have a list of all the drugs the Dr's use for depression and Zyprexa is not one of them.
