Yes, you can invite Carmol 40 over the counter.

Not in New York State; possibly elsewhere. Call any local pharmacy and ask this question and you'll get an accurate answer for your state.
Beware, I called a Rite Aid and was told Carmol 20 (OTC) is about $26, but Rx only Carmol 40 is $200!! Probably cause the corporation sees this as a way to make money for those who have drug insurance.
